Compliant Not Confused: Energy Reporting Policies

New National Energy Benchmarking Laws Expose Commercial Real Estate Owners to Big Fines & Big Opportunities

As mandatory energy benchmarking and building energy policy are gaining momentum across the country, cities are using it to promote energy efficiency and drive more rebate and incentive programs. As many as 10 cities now require mandatory annual benchmarking for commercial buildings and set penalties (as much as $100/day) for non-compliance.

Below is a list of cities, counties and states that have passed laws requiring benchmarking and reporting for commercial real estate. Current regulations vary in terms of the types and sizes of buildings they affect, in addition to the associated fees.

Please review the entire Privacy Policy to learn the types of End User information greeNEWit gathers, how greeNEWit uses that End User information, what End User information is disclosed and to what third parties, and how greeNEWit safeguards your End User information.  As used in this Privacy Policy, the terms “use,” ”using,” “process,” and “processing” information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within the greeNEWit enterprise or among its affiliates within the United States or internationally.

This Privacy Policy applies only to the greeNEWit Service and greeNEWit Website (including the greeNEWit Blog and greeNEWit Content Distribution Outlets).  This Privacy Policy does not apply to any Web sites managed, maintained, and/hosted by third parties not directly affiliated with greeNEWit that you may visit, e.g., via a link on the greeNEWit Website or on a Web site maintained by any third party.  greeNEWit does not control the privacy policies of other Web sites to which we may provide hyperlinks.  We encourage you to learn more about the online privacy and data security policies of third party Web sites directly from such third parties, as their policies may differ from greeNEWit’s.

User Data We Collect

We collect two types of user data: (1) technical data that is automatically collected from all visitors to the greeNEWit Site (“Log Data”); and (2) data that you voluntarily submit to us (described below under "Personal Information").

Log Data.  If you do nothing during your visit except browse through our Website, read pages, or download information, we will gather and store certain information about your visit automatically.  This information does not identify you personally.  We automatically store the following information:

1. The Internet domain (for example, "xcompany.com" if you use a private Internet access account, or "yourschool.edu" if you connect from a university's domain) and IP address (an IP address is a number that is automatically assigned to your computer whenever you are surfing the Web) from which you access our Website.

2. The type of browser and operating system used to access our site.

3. The date and time you access our site.

4. The pages you visit.

5. If you linked to www.greeNEWit.com from another website, the address of that website.

We use this information to help us make our site more useful to visitors---to learn about the number of visitors to our site and the types of technology our visitors are using. We do not track or record information about individuals and their visits.

Personal Information.  If you choose to provide us with Personal Information by filling out our "contact us" form, become a member using the greeNEWit services, or if you send an email to us, we use that information to contact you.  Personal Information includes, but is not limited to, your name, username, phone number, credit card or other billing information, email address and home and business postal addresses, and any other information that you decide to provide to greeNEWit that could be used to personally identify you.  We use your Personal Information for business purposes, which mainly include operating the greeNEWit Website, registering End Users to the greeNEWit Service as Members, providing the greeNEWit Service, responding to correspondence from you, and when you participate in certain activities on the greeNEWit site, including when you:

We use your Personal Information (in some cases, in conjunction with your Log Data) mainly to provide the greeNEWit Service, complete your transactions, and respond to correspondence from you.  For example, we may collect information regarding your access to and use of the greeNEWit Service and greeNEWit Website, such as your bidding history, sales participated in, sales won/lost, prices paid, bids used and other similar information associated with your account.  We use such information solely in accordance with this Privacy Policy.  We may also use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you.  If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update your “user preferences” information.

We may also combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other End Users to attempt to provide you with a better experience, to improve the quality and value of the greeNEWit Service and to analyze and understand how the greeNEWit Service and greeNEWit Website are used.

Under no circumstances will we supply information in our database to a third party except as described below.  In fact, if we select you to receive an informational email from us, we will give you the opportunity to unsubscribe from the list.

Cookies

We collect some data through the use of cookies. Cookies are identifiers that are transferred to your computer's hard drive and either stored permanently for future access by the transferor ("Long-term Cookies") or temporarily (“Short-term Cookies”) or that are transferred temporarily to your computer's Random Access Memory ("Session Cookies").

We may transfer a Long-term Cookie only if you are notified prior to the cookie being stored and allow the transfer of the cookie. We may use Session Cookies whenever you visit the greeNEWit site to analyze our Website traffic or for the Website’s interactive applications.  Session Cookies last only as long as your session on the greeNEWit site.  We also may use Short-term Cookies are set to expire within one hour of their being placed on your hard drive.

To the extent that greeNEWit operates multiple websites, we may use a separate cookie to track each site's aggregated page, which tells us which features are most interesting to End Users.  The cookies that the greeNEWit Website uses do not store Personal Information, but they may store Non-Identifying Information.  Since cookies are now used as industry standard, most Web browsers automatically accept cookies, but you can usually change your browser to decline them.  If you prefer not to enable cookies, you may choose to disable them; however, please note that certain features on the greeNEWit Website will not be available to you once cookies are disabled.

When you access content through the greeNEWit Service and the greeNEWit Website, you will be accessing greeNEWit’s central server and not your personal computing device or other hardware.  The greeNEWit Service and greeNEWit Website will not at any time expose any files or personal information on your personal computing device or other hardware to greeNEWit or other third parties or otherwise enable greeNEWit or any other third party to have direct access to any of the files or personal information on your personal computing device or other hardware.

greeNEWit and its service providers use Secure Sockets Layer (SSL) encryption on all Web pages of the greeNEWit Website where Personal Information is required to effect a monetary transaction.  greeNEWit and its service providers use SSL encryption and otherwise exercise reasonable care in providing secure transmission of information from your personal computing device to our servers and ensuring the security of your information on our systems. To use the greeNEWit Service or to otherwise make purchases from greeNEWit, you must use an SSL-enabled browser to protect the confidentiality of your personal and credit card information while it is transmitted over the Internet.  Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we take steps to protect your information, greeNEWit cannot ensure or warrant the security of any information you transmit to us, and you do so entirely at your own risk.

How We Use the Data We Collect

Log Data is collected automatically by the greeNEWit Website servers and related software.  Because the greeNEWit Website automatically collects Log Data for all End Users that visit the greeNEWit Website, your greeNEWit Website session will be tracked.

If you wish to remain anonymous in public areas of the greeNEWit Website, you can browse those areas of our greeNEWit Website without entering any Personal Information and, therefore, remain anonymous during your visit.

Additionally, in some of our email messages, greeNEWit may use a “click-through URL” linked to content on the greeNEWit Website.

When an End User clicks onto one of these URLs, the End User will pass through our Web server before arriving at the destination Web page.  greeNEWit tracks this click-through data to help us determine End User interest in certain subject matter and measure the effectiveness of these End User communications.  You can avoid being tracked in this way by not clicking text or graphic links in emails from greeNEWit.

Finally, we may use clear gifs or pixel tags, which are tiny graphic images, in order: (i) to advise us of what parts of the greeNEWit Website End Users have visited, (ii) to measure the effectiveness of any searches End Users perform on the greeNEWit Website, and (iii) to enable us to send emails in a format that End Users can read and tell us whether such emails have been opened in order to ensure us that we are sending messages that are of interest to End Users.

The End User information that greeNEWit collects may be added to our databases and used for business purposes, including for marketing and promotional purposes, for a statistical analysis of End Users' behavior, for product development, for content improvement, or to customize the content and layout of our greeNEWit Website.  In addition, greeNEWit will, on occasion, send emails to you about our services or third-party products.  If you do not want to receive email from us, visit the “Opt Out” link at the bottom of any greeNEWit email to remove yourself from continued receipt of email messages or send an email to us at [optout@greeNEWit.com].

Third Party Disclosures

We do not disclose identifying information to any third parties, except under the following circumstances:

IT Service Providers.  Your information may be available to third parties providing computer system administration services, maintenance or other services to our firm Websites, networks, servers, communications or databases.  However, under no circumstances do we permit such third parties to use that information for other purposes.

Legal Requirements.  We may provide your information to governmental agencies or other third parties as required by law and regulations, including responding to subpoenas, court orders or other legal processes.  We additionally may release End User information when we believe, in our sole discretion, that release is appropriate: including but not limited to, to enforce or apply the Agreement, including the Terms of Service and other agreements, rules, and policies; to protect the rights, property, or safety of greeNEWit, our End Users, or others; or to prevent activity that we believe, in our sole discretion, may be or may become illegal, unethical, or legally actionable (including exchanging End User information with other companies and organizations for fraud protection).

Business Partners and Service Providers.  We work closely with certain business partners and service providers and we may provide End User information to our business partners and service providers so that they can provide services to you.  For example, we may provide End User information to our business partners or other trusted entities for the purpose of providing you with information on goods or services we believe will be of interest to you.  We may also employ third party companies and individuals for any of the following:  to facilitate the greeNEWit Website or greeNEWit Service; to provide the greeNEWit Website or greeNEWit Service on our behalf; to perform related services, including without limitation, maintenance services, database management, fulfillment, web analytics, and improvement of the features or functionality; or to assist us in analyzing how the greeNEWit Website or greeNEWit Service is being used.

You may avoid having greeNEWit share your information with its business partners and service providers by not granting greeNEWit permission to share your information.  Not granting greeNEWit permission to share your information with its business partners or service providers may limit your access to their services through the greeNEWit Website.

Business Transfers.  As we continue to develop our business, we may buy, sell, or share assets in connection with, for example, a merger, acquisition, reorganization, a sale of assets, or bankruptcy.  In such transactions, information about End Users generally is often a transferred business asset.  In the event that greeNEWit itself or substantially all of greeNEWit’s assets are acquired, information about our End Users may be one of the transferred assets.

Aggregate Site Use Information.  We may release aggregate End User information (without revealing any Personal Information about you) to advertisers and other third parties in order to promote or describe use of the greeNEWit Website or the greeNEWit Service.

International Transfer

Your information may be transferred to and maintained on computers and servers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.  If you are located outside the United States and choose to provide information to us, greeNEWit transfers Personal Information to the United States and processes it there.  Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
